Mr. Rakesh Gupta, Advocate for the petitioner. **** VIKAS SURI , J. (Oral) CM No.20644-CII of 2024 This is an application under Section 151 CPC for modification of the order dated 21.10.2024.

Learned counsel for the applicant-petitioner submits that the statement made by him during the course of hearing noticed in order dated 21.10.2024 is the result of miscommunication and the same is factually incorrect. The petition under Section 125 Cr.P.C. is still pending before the trial Court and no interim maintenance has been awarded till date. It is further submitted that during the pendency of the present petition, more developments have taken place and the applicant-petitioner does not want to further prosecute the present petition, as such. He, thus, seeks withdrawal of the main petition.

Heard.

Learned counsel for the petitioner seeks withdrawal of the present petition in view of law laid down by a Division Bench of this Court in Hemant Bhagat and others Vs. Prekshi Sood Bhagat, decided on 25.10.2024 (2024:PHHC:140559-DB).
