IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CWP-24508-2023 Decided on : 26.10.2023 Narender Kumar and another . . . Petitioner(s)
Versus
State of Haryana and others . . . Respondent(s) CORAM: HON'BLE MR. JUSTICE SANJAY VASHISTH PRESENT: Mr. Ajay Vijarania, Advocate for the petitioner(s).
**** SANJAY VASHISTH , J. (Oral) 1.
Present writ petition has been filed by the petitioners, for issuance of a writ in the nature of Certiorari, for setting aside the impugned action of the respondents, by which, income of the family ID/PPP of the petitioners, have been increased.
2.
Learned counsel for the petitioners submits that earlier the annual income of the petitioners was assessed as Rs.1.80 lakhs to Rs.2.25 lakhs, however, without any intimation to the petitioner, now the same has been enhanced to Rs.1.80 lakhs to Rs.3.00 lakhs per annum. Said action of respondents No.2 & 3, has made sons of the petitioners ineligible for getting benefit of post-matric scholarships for SC category, who are studying at the Technological Institute of Textile & Sciences, Bhiwani, and Maharaja Aggresain Medical College, Agroha (Hisar).
3.
At this stage, learned counsel points out that in regard to the correction of the said ambiguity, appropriate representations dated 18.10.2023 (P-7) & 16.10.2023 (P-8), respectively have been moved by the petitioners. However, final decision on the said representations is yet to be JAWALA RAM 2023.10.26 18:59 I attest to the accuracy and integrity of this document

5.
I have examined the submissions and the facts narrated in the writ petition along with appended documents. Counsel for the petitioners is unable to explain as to when the petitioners came to know about the alleged mistake committed by the respondents/Department. However, he submits that because of incorrect calculation in the income of the petitioners, they would not be able to apply for the benefit of post-matric scholarship for SC category, as the last date for which is fixed as 30.10.2023. 6.
However, in the given facts and circumstances, present writ petition is disposed of with a direction to the respondents to look into the grievance of the petitioners, and take a final decision over the representations dated 18.10.2023 (P-7) & 16.10.2023 (P-8), respectively, moved by the petitioners.
Looking at the benefit of post-matric scholarship meant for the upcoming students from the SC category, it would be appreciated, if respondents/authorities concerned, would take some decision before the last date fixed for applying for availing such benefit of the aforesaid scheme. 7.
With the aforesaid observations, present writ petition stands disposed of.
