(ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.47 dated 12.06.2023 under Section 21 of the NDPS Act, 1985 (Section 29 of the NDPS Act added later on) registered at Police Station Bhadaur, District Barnala.

Vide order dated 31.10.2023, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the petitioner has been arrayed as an accused on the basis of a disclosure statement allegedly suffered by co-accused Davinder Singh @ Deep @ Ammna Dhillon from whom a recovery of 07 grams of heroin (non-commercial) was allegedly effected." 3.

Learned State counsel, on instructions from ASI Jasmail Singh, has submitted that no doubt the petitioner has joined investigation in compliance of order dated 31.10.2023, however, in the interregnum, the petitioner has been involved in another case under the NDPS Act i.e. FIR No.8 dated 29.01.2024 registered at Police Station PUNEET SACHDEVA 2024.03.06 09:38 I attest to the accuracy and integrity of this document Chandigarh

In the circumstances, this Court would not be inclined to extend the extraordinary concession of anticipatory bail to the petitioner as he comes across to be a habitual offender. 5.

The instant petition stands dismissed.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
