(ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in FIR No.259 dated 07.12.2023 under Sections 22 and 29 of the NDPS Act, registered at Police Station Mahilpur, District Hoshiarpur.

Vide order dated 14.11.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned State counsel, on instructions, has not controverted that the petitioner came to be nominated as an accused on the basis of a disclosure statement allegedly suffered by co-accused Harpreet Singh and Jiwan Kumar, from whom a recovery of 31.25 grams of Alprazolam was affected. It has also not been disputed by the learned State counsel that the alleged recovery affected from the co-accused is much less than the minimum classified as commercial under the NDPS Act..

Learned State counsel, on instructions from ASI Dilbagh Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation. 5.
In view of the above, the petition is allowed and interim order dated 14.11.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
