Aggrieved by delay tacƟcs of the complainant at the Ɵme of dismissal of second cancellaƟon report in the FIR capƟoned above, the accused has come up before this Court under SecƟon 482 CrPC.

NoƟce served upon the official respondent through State counsel. The nature of order which this Court proposes to pass, there is no necessity of calling any response from the State.

Earlier, vide order dated 11.01.2022, the Chief Judicial Magistrate, Hoshiarpur had directed for further invesƟgaƟon at the request of the complainant. Subsequently, the invesƟgaƟon was conducted which resulted in filing of second cancellaƟon report. Now the accused is aggrieved of the pendency of the cancellaƟon report.

In view of prayer made by counsel for the peƟƟoner, the Chief Judicial Magistrate to expedite the hearing of the case on priority and shall give atleast two opportuniƟes to the complainant to represent his case.
