Mr. Jasdeep Singh Gill, Advocate for respondents No. 2 and 3. **** ANOOP CHITKARA, J. (ORAL) Counsel for the petitioner seeks cancellation of bail on the grounds that respondents No. 2 and 3 have violated the condition of not contacting the complainant party. Counsel for respondents No. 2 and 3 submits that the houses of the complainant and accused are opposite to each other and whenever accused/respondents No. 2 and 3 leave their houses, they have to pass through same passage. Furthermore, counsel for respondents No. 2 and 3 submits that apart from the conditions already imposed in the previous order, he would have no objection if this Court does not cancel the bail and imposes further stringent conditions. Since in condition No.

2 this Court had mentioned that distance of 100 meter stay and given the fact that the houses are opposite, it should not be construed as 100 meter whenever respondents No. 2 and 3 has to cross the common road with clarification that they would not stare obnoxiously at the complainant's house. It is further clarified that in case, they stare obnoxiously at the complainant, then on this ground alone, it shall be permissible for the petitioner to file an application for cancellation of bail.

Petition stands disposed of.
