Charanjit Kaur v. State Of Punjab And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 37958 of 2018 Date of decision : 09.01.2019 Charanjit Kaur ....Petitioner V/s State of Punjab & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Aminder Singh, Advocate for the petitioner. RAJAN GUPTA J.
Petitioner was given compassionate appointment as a Lady Guard in the Punjab Home Guards department. She served in the department for a period of 28 years and ultimately superannuated on 11.07.2018. She now claims that her date of birth has been wrongly recorded. Same be corrected in the record as 11.07.1965. A mandamus be, thus, issued to the department to re-instate the petitioner on the same post. It has been urged before the court that the record including aadhar card of the petitioner clearly shows that she was born on 11.07.1965. This court finds no merit in the plea. The petitioner remains in service for 28 years and has admittedly retired now. She has been paid retiral benefits and is drawing pension as per rules. Her plea for correction of date of birth is mis-conceived. Petition is in fact frivolous in nature. Same is hereby dismissed.
