**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner is praying that his pay was wrongly fixed while implementing the revision as carried out w.e.f. 01.01.1996 and thereafter from 01.01.2006.
Petitioner has already been retired from service on 30.09.2009 and the present writ petition has been filed by him after more than nine years of the retirement. Even the representation which the petitioner has supposed to have given is dated 15.12.2017 (Annexure P-9).
Today, during the course of the hearing counsel for the petitioner states that the petitioner will be satisfied, at this stage, in case a time bound is issued to the respondents to decide his representation dated 15.12.2017 (Annexure P-9) by passing a speaking order. CWP-37933-2018 -2In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 15.12.2017 (Annexure P-9) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for refixation of salary with retrospective effect, the same shall be done notionally and no arrears shall be given to him.
Present writ petition stands disposed of.
