NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the report dated 15.09.2022 (Annexure P-2) whereby the checking staff of the respondents held that the petitioner was drunken while driving and held him responsible for damaging the bus while driving. Further prayer has been made to quash the order dated 19.09.2022 (Annexure P-3) whereby the petitioner has been relieved/terminated from duty without according opportunity of hearing. Further a writ of mandamus has been sought for directing the respondents to appoint/reinstate the petitioner as Driver in the respondent - department regarding which the petitioner has already represented via letter dated 27.02.2023 (Annxure P-4) and not to replace the petitioner by the similar set of employees.
