(Oral) This is the third petition filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR No.82 dated 06.07.2020 under Section 21 of NDPS Act (Section 29 of NDPS Act added later on) registered at Police Station STF Mohali District SAS Nagar.

The previous petition seeking similar relief was dismissed by this Court on 24.09.2021 vide a detailed order, which has been annexed as Annexure P-10. It also needs to be pointed out that even the first petition filed by the petitioner under Section 438 Cr.PC was dismissed on 25.01.2021 on merits.

Learned counsel for the petitioner has reiterated the submissions, which were made on the previous two occasions when similar relief was sought from this Court by arguing that the petitioner SONIA BURA 2024.10.18 12:22 I attest to the accuracy and integrity of this document

CRM-M-51603-2024 has been falsely implicated in the instant case on the basis of a disclosure statement allegedly suffered by co-accused Paramjit Kaur @ Bhola from whom the alleged recovery of 333 grams of heroin was affected along with the drug money.

A pointed query was put to the learned counsel as to what was the material change in circumstances, which would warrant acceptance of the instant petition, however, he has failed to bring to the notice of this Court any such material change in circumstances. Rather it is a matter of record that the petitioner has been declared a proclaimed offender vide order dated 10.09.2021 by the learned Special Judge, Jalandhar.

In the aforementioned facts and circumstances, no ground is made out to extend the extraordinary concession of anticipatory bail to the petitioner, more so, when as already observed earlier the petitioner is a proclaimed offender. Accordingly, the present petition stands dismissed.
