ANIL KSHETARPAL, J(Oral) Decree holder is in the revision petition against the order passed by the learned Executing Court whereby relief for recovery of salary from August 2004 till 09.01.2016 has been dismissed. Learned Executing Court has noticed that the learned first appellate court had only awarded pay for the months of July and August, 2008 and the aforesaid amount has already been paid. Learned counsel faced with this situation, submits that he may be permitted to withdraw the revision petition with liberty to move an application before the learned first appellate court for modification of the decree, if maintainable, in accordance with law. In view of the prayer made by learned counsel for the petitioner, the present revision petition is dismissed as withdrawn with liberty aforesaid.
