Learned counsel for the petitioner submits that two prayers were raised in the present petition by the petitioner, one is that the petitioner be allowed to join at Panipat on the post of conductor, keeping in view the transfer order dated 02.08.2018 passed by the respondents-department, copy of which has been appended as Anneuxre P-1 and second one is that the period for which the petitioner was allowed to discharge his duties be treated as duty period.

Learned counsel for the petitioner further submits that though vide order dated 26.12.2018, copy of which has been appended as Annexure R-1, the petitioner has been allowed to join the duties at Panipat but, the period from August to December 2018 has not been treated as a duty period which is causing prejudice to the petitioner. 3.

Upon this, learned counsel for the respondents-State submits that with regard to the claim of the petitioner for pending period from August to December, 2018 as duty period an appropriate order will be passed by the respondents-department within a period of eight weeks from the date of receipt of certified copy of this order and in case, the petitioner is found RIYA 2024.02.23 12:59 I attest to the accuracy and integrity of this document

CWP-38192-2018 (O&M) -22024:PHHC:021377 eligible for the grant of said relief, the same will be extended to him forthwith, otherwise, an appropriate speaking order will be passed for the information and necessary action of the petitioner. 4.

Learned counsel for the petitioner submits that keeping in view the statement made by learned counsel for the respondents recorded herein above, the present petition may kindly be disposed of having been not pressed any further.
