***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, titled 'Hardeep Singh Sidhu v/s Jaspreet Kaur Sidhu', filed by the respondenthusband, pending in the Family Court, Bathinda and she seeks transfer of the same to the Court of competent jurisdiction at Mansa. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 08.12.2021 and two sons born from the said wedlock, who are about 3 years and 1 year old, are in the care and custody of the applicant. TA-1131-2025 not having any source of earning. She along with her sons, are dependent upon the parental family. Even, she has filed the petition under Section 144 of Bharatiya Nagarik Suraksha Sanhita, petition under the Protection of Women from Domestic Violence Act, as well as petition under Section 18 of Hindu Adoption and Maintenance Act, 1956, which are pending in the Courts at Mansa and the respondent is pursuing all the aforesaid cases.

Considering the aforesaid submissions, more particularly, considering the fact of the applicant not having any source of earning, while taking care of the two minor children as well as the fact of three cases arising from the matrimonial dispute, already pending in the Courts at Mansa, whereby the respondent is making appearance and above it, the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act, titled 'Hardeep Singh Sidhu v/s Jaspreet Kaur Sidhu', filed by the respondent-husband, stands transferred from the Family Court, Bathinda, to the Court of competent jurisdiction at Mansa. The requisite record of the aforesaid case be sent by the Family Court, Bathinda, to the District and Sessions Judge, Mansa.

Learned District and Sessions Judge, Mansa, shall assign the said petition to the Family Court, Mansa. Even, the parties are directed to appear before the Family Court, Mansa, within a period of one month from today onwards.
