  +Learned counsel for the petitioner relying upon office memorandum dated 03.03.2023 issued by Ministry of Personnel, Public Grievances and Pensions submits that employees were given one time option to opt for Old Pension Scheme by 31.08.2023. The petitioner was entitled for benefit, however, he was not informed of the office memorandum, thus, he could not avail the benefit by 31.08.2023.

From the perusal of paragraph 4 of memorandum, it prima facie appears that there was no requirement on the part of respondents to send notice of the Scheme to each and every employee. Faced with this, learned counsel for the petitioner seeks a short accommodation to cite judicial pronouncement on the issue.
