The present peƟƟon has been filed under SecƟon 482 CrPC read with SecƟon 528 of BNSS, 2023 for quashi ng of above capƟoned FIR along with all subsequent proceedings arising therefrom. 2.
State counsel on instrucƟons from ASI Jaswinder Pal submits that the police report has been filed but charges have not been framed. 3.
In view of aforesaid submissions of State counsel, counsel for the peƟƟoner submits that he would be contended and saƟsified in case, he be permiƩed to file a discharge applicaƟon and to enable that he be supplied the copy of police report under SecƟon 230 BNSS (old SecƟon 207 CrPC).
4. Given above, the present peƟƟon stands disposed of with permission to the peƟƟoner to file a discharge applicaƟon within 15 days of the receipt of the police report. This Court requests the trial Court to decide the discharge applicaƟon before proceedings further to pass any order on charges on merits. State is also requested not to seek any unnecessarily adjournment.
