Mr. Amitoj Singh Dhaliwal, DAG, Punjab ******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.187 dated 26.06.2017 registered for the offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Sadar Nakodar, District Jalandhar. Heard.

Vide order dated 28.02.2019, earlier bail application (CRM-M45901-2018) filed by the petitioner was dismissed by the co-ordinate Bench with following observations:- "Keeping in view the fact that the recovery falls in commercial quantity, therefore, bar of Section 37 of the NDPS Act will apply in this case and the petitioner is not entitled to the benefit of bail."

CRM-M-49203 of 2019 -2I find no reason to accept the submission of learned counsel for the petitioner to over-side the observations made by co-ordinate Bench in CRM-M-45901-2018).

Consequently, this petition has no merit and the same is dismissed.
