(ORAL) Challenging the dismissal of the applicaƟon whereby the CBI Court had declined the request to summon defence witness on the ground of delay and other reasons, the accused had come up before this Court.

The accused-peƟƟoner counsel submits that it would be in the interest of jusƟce to summon SecƟon Officer as DW-3.

Mere summoning of SecƟon Officer does implies that some personal informaƟon was sought to be delivered from the said officer because the witness has not been menƟoned by name but by designaƟon.

The prosecuƟon witnesses were examined way back in 2009 upto 2014 at Ɵme the accused kept on siƫng on the fence and now apparently with a view to delay the trial, he has filed the present applicaƟon. On the face of it, these are the tacƟcs to delay the conclusion of the criminal prosecuƟon.

Given above, the present peƟƟon is dismissed. The trial Court is directed to expedite the trial on top priority. ParƟes are directed not to seek any unnecessary adjournment.
