The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue passport.

The petitioner was issued passport on 10.09.2013 which expired on 09.09.2023. The petitioner applied for re-issuance of passport, however, police has submitted adverse report on account of FIR No. 222 dated 13.11.2019, under Sections 302, 323, 148 and 149 of IPC, registered at Police Station Guru Harsahai, District Ferozepur. 3.

Learned counsel for the petitioner inter alia contends that police after completing investigation filed cancellation report which was not accepted by trial court and police was asked to make further investigation. CWP No.24606 of 2023 -2- 2023:PHHC:139384 Till date police has not filed cancellation or otherwise report against the petitioner. Case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.

Learned State counsel confirms the aforesaid factual position with respect to above noted FIR.

Learned counsel for Union of India, in wa ke of statement of learned State counsel, submits that case of the petitioner would be considered and an appropriate order shall be passed within six weeks from today.

In the wake of statement of learned counsel for Union of India, petitioner stands disposed.
