***** RAJ MOHAN SINGH, J .(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.194 dated 25.9.2019 registered under Sections 18, 25, 29 and 61 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station City Jagraon, District Ludhiana.
In CRM-M No.54054 of 2019 titled 'Jaswant Singh @ Jassa vs. State of Punjab' regular bail has been granted by this Court vide order dated 21.01.2020. Ad per allegations, 1 Kg. opium has been recovered from car bearing No.UK-18G-4530 Make i20.
-2The FIR was registered on the basis of secret information. On the basis of secret information, the aforesaid car was stopped and alleged contraband i.e. 1 Kg. opium was recovered. Three persons were the occupants of the car. Quantitiy of 1 Kg. opium falls under non-commercial quantity. Coaccused Jaswant Singh @ Jassa was involved on the basis of interrogation of the petitioner when he told that the he has purchased 1 Kg. opium from Jaswant Singh @ Jassa resident of Karnal. The accused has also disclosed that on that day also they had planned to go to Karnal for purchasing 2 Kgs. of opium from Jaswant Singh @ Jassa. Thereafter, police completed the process of recording the statements of aforesaid accused persons and proceeded from Jagraon to Karnal and ultimately, Jaswant Singh @ Jassa was arrested along with 1 Kg. 600 grams of opium and currency notes of Rs.50,000/-. The case appears to be arguable.
Learned State counsel on instructions from ASI Janak Raj has endorsed the aforesaid facts from the police file. At this stage, without meaning anything on the merits of the case, it would be just and appropriate to release the petitioner on regular bail.
In view of above, the present petition is allowed and the petitioner is ordered to be enlarged on bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of
-3trial Court/Duty Magistrate concerned.
Nothing expressed hereinabove shall be construed to be an opinion on merits of the case.
