(ORAL) The petitioners have sought anticipatory bail in case FIR No.138 dated 26.11.2018 registered under Section 61 of Excise Act, 1914 at Police Station Koom Kalan, District Ludhiana. Mr. Shireesh Gupta, Senior Deputy Advocate General, Punjab, on instructions from ASI Mohan Lal, submitted that during investigation, it was found that the petitioners were not involved in commission of offence as the petitioners were sought to be apprehended on the disclosure statement made by the co-accused.

Keeping in view the facts and circumstances of the present case, without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. However, in the event of arrest, they shall be released on bail to the satisfaction of the Arresting Officer, subject to the conditions contained in Section 438 (2) Cr.P.C and shall join the investigation as and when required.
