(ORAL) CM No.4070-CII of 2021 This application has been moved by the respondent-insurance company for seeking pre-ponement of the date of hearing in FAO No.633 of 2019 from 28.07.2021 to some earlier date as it has entered into a settlement with the appellant.

to the appellant in advance and they accept the notice and also confirm the factum of the afore-said settlement having been arrived at between the appellant and the respondent-insurance company and have no objection in allowing the present application.

Keeping in view the above-discussed facts and circumstances, the instant application is allowed and the said main FAO is taken on the board today itself.

Appellant Tej Bhan has preferred this appeal for seeking enhancement of the amount of compensation as awarded to him by learned MAC Tribunal, Sirsa, vide the Award dated 10.08.2018 on account of his having sustained the injuries in the accident in question leading to the amputation of his leg and thereby resulting in his permanent disability. Annexure A-2 is the copy of the Demand Draft as got issued by the respondent-insurance company in the name of the appellant for a sum of `5,50,000/- and the appellant acknowledges the transfer of the above-said amount in his bank account towards the payment of the enhanced compensation and he further submits that his claim for the enhanced compensation, as set-forth in the present appeal, stands satisfied and the present appeal be disposed of accordingly.

An affidavit of the appellant has also been received on the 'Whatsapp Group for Video-Conferencing" of this Court and is taken on the record wherein he has made depositions regarding the payment of the aforesaid amount by the respondent-insurance company to him towards the full

and final settlement of his claim for the enhanced compensation. Resultantly, the present appeal stands disposed of accordingly in the terms of the above-said settlement as arrived at between the appellant and the respondent-insurance company.
