The grievance, which propelled the petitioner to approach this Court under Section 482 Cr.P.C. is the pendency of the criminal revision No. 141 of 2023, titled as Priya Aggarwal vs Vikas Sharma, pending before the learned Additional Sessions Judge, Amritsar, which is now fixed for 27.11.2024.

The petitioner made an innocuous and bonafide prayer that a mandamus be passed upon the learned revisional court concerned, to decide the said revision in a time bound manner. He further submits that the criminal complaint, which was filed by the petitioner in the year 2018, is still pending, and the revision petition has been preferred by the accused/respondent before the learned revisional court concerned, DALBIR SINGH TIWANA 2024.10.22 16:56 I attest to the accuracy and integrity of this document

CRM-M-52174-2024 challenging the order of the learned trial court concerned, whereby the defence evidence of the petitioner-accused was closed vide order dated 5.9.2023.

This Court after hearing the learned for the parties concerned, is of the considered view that there is merit in the instant petition. As the innocuous and bonafide prayer is made, therefore, no prejudice would be caused to the respondent, if the asked for mandamus, is issued to the learned revisional court concerned. Therefore, the instant petition is disposed of with the direction to the learned revisional court concerned, to decide the aforesaid criminal revision, as pending before the latter concerned, expeditiously preferably within three months from the date of receipt of certified copy of this order.
