*** HARSIMRAN SINGH SETHI , J. (ORAL) Counsel for the petitioner argues that the benefit, which has been sought by the petitioner in the present writ petition, was also denied to one Sh. Ved Parkash Sharma by passing an identical order on 11.07.2018 and Sh. Ved Parkash Sharma filed a contempt petition being COCP No.1046 of 2018 and during the pendency of the said proceedings, the arrears for the period from 2005 till 2007 for working on the post of Sub-Divisional Engineer, has also been extended to him and therefore, on the same analogy, petitioner is also entitled for the said benefit. Counsel for the petitioner states that after passing of the order dated 08.10.2018 (Annexure P-9), petitioner served upon the respondents a legal notice dated 16.10.2019 (Annexure P-16) bringing these facts to their notice, but no action has been taken so far and the said NARESH KUMAR 2019.12.02 12:44 I attest to the accuracy and integrity of this document Chandigarh

CWP-33843-2019 -2legal notice is still pending consideration with the respondents. Counsel for the petitioner further states that the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 16.10.2019 (Annexure P-16) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
