(ORAL) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 443 dated 21.12.2018 (Annexure P-1) registered under Section 376 IPC and Sections 4 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Zirakpur, District SAS Nagar Mohali. Learned counsel for the State has filed custody certificate dated 23.08.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 04 years, 07 months and 07 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.
