The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to re-issue his passport.

The petitioner was issued passport which expired with the afflux of time. An FIR No. 136 dated 08.08.2019, under Sections 427, 506, 452, 148, 149 of IPC came to be registered against the petitioner. The petitioner applied for re-issuance of passport on 12.01.2023. The respondent has not issued passport on account of pendency of aforesaid FIR against the petitioner.

Learned counsel for the petitioner states that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391

Learned State counsel, who on advance notice is present in Court, submits that police has not filed its report under Section 173 Cr.P.C. 5.

Faced with this, learned counsel for Union of India in the wake of statement of learned State counsel, submits that application of the petitioner would be disposed of within six weeks from today. 6.

In the wake of statement of learned counsel for Union of India, the petition stands disposed of.
