(Oral) Prayer in this writ petition is for setting aside sale notice dated 07.10.2023 (Annexure P-4) vide which auction of the property as detailed in the petition was to be held on 27.10.2023. There is further prayer for directing respondent No.1 to receive the part payment of Rs.15,00,000/- out of the total amount of Rs.52,44,435.84 and recommend case of the petitioner for One Time Settlement.

Learned counsel for the respondent - Bank on advance notice informs that present writ petition is infructuous as the sale could not fructify on 27.10.2023. Moreover objection qua maintainability of the writ petition itself has also been raised.
