Dated Police Station Sections 14.8.2022 City-1, Mansa 22 NDPS Act The petitioner incarcerated for violating the provisions of Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act) per the FIR captioned above, has come up before this Court under Section 439 CrPC seeking bail seeking interim bail to get his proper medical treatment being patient of Hepatitis C Virus and also HIV positive.

State counsel has shown certificate issued the Medical Officer, District Jail, Mansa, wherein it has been mentioned that the patient does not require medicines as of now and the sample is required to be repeated after three months. A copy of the same has been supplied to the petitioner. Given above, the present petition is dismissed. However, liberty is reserved to the petitioner to file a fresh petition in case the petitioner wants to question this report.

CRM-M-57414-2022 Given this, the jail authorities are directed to get the required tests of the petitioner conducted from a reputed private laboratory at the costs of the petitioner. Such tests be conducted without any delay, not later than five days from today.

Liberty reserved to the petitioner to file fresh petition in case he is able to substantiate his medical condition and disposal of this petition shall not come in his way. Furthermore, the attendant of the petitioner may also visit him and file his affidavit regarding his health conditions. There would be no need for a certified copy of this order, and any Advocate for the Petitioner and State can download this order and other relevant particulars from the official web page of this court and attest it to be a true copy. The concerned officer can also verify its authenticity and may download and use the downloaded copy for immediate use.
