Briefly stated facts of the case are that in a civil suit titled 'Munsi Vs. Jage Ram and others', pending in the Court of Civil Judge (Jr. Divn.) Pataudi, the plaintiff had filed an application U/o 6 Rule 17 CPC for amendment of the plaint so as to seek a decree for mandatory injunction for issuance of direction to the defendants to remove the construction/obstruction over killa No.8/1/2(3-3) raised/caused during pendency of the suit and to hand over the vacant possession in its original form.
