This is the second petition filed on behalf of the petitioner seeking grant of anticipatory bail in FIR No.191, dated 10.11.2022, Police Station Bullowal, District Hoshiarpur, under Section 21(1) of Mines & Mineral (Development & Regulation) Act, 1957 and Sections 379 and 506 IPC.

The earlier petition i.e. CRM-M- 55449-2022 had been dismissed on merits vide order dated 30.11.2022 (Annexure P-2). However, when the previous petition had been taken for final hearing, it had been informed by the learned State counsel that the petitioner happens to be involved in one more case.

Today, learned State counsel upon whom an advance copy had already been furnished has informed that it was on account of some MOHAN SINGH 2022.12.12 19:54 I attest to the accuracy and integrity of this document

CRM-M-57452-2022 (O&M) - 2 - miscommunication that incorrect information came to be furnished and that as a matter of fact, the petitioner is not involved in any other case as has been confirmed by ASI Kashmiri Lal. 4.

The Senior Superintendent of Police, concerned, to ensure that all the instructing officials furnish accurate information when they appear in the Court.

As regards merits, this Court finds that the same have been duly discussed in the order dated 30.11.2022 passed in previous petition i.e. CRM-M- 55449-2022.

Depletion of environmental resources is a major challenge of current times. And if it goes unchecked it can create havoc. The society has a responsibility towards future generations to pass on a liveable environment. No leniency can be shown in such like matters, which have an irreparable adverse effect on the environment. As such, no special case for grant of anticipatory bail is made out. The petition is sans merit and is hereby dismissed.

However, in case the petitioner surrenders before the Trial Court within a period of 10 days from today and applies for grant of regular bail, the learned Trial Court shall endeavour to dispose of the same expeditiously preferably within a period of one week from filing of such application.
