Prayer in this petition is for setting aside the order dated 14.11.2022 passed by the Additional Sessions Judge, Amritsar, in FIR No.244 dated 14.09.2021 under Section 22(c) of NDPS Act, registered at Police Station Division-B, District Police Commissionerate Amritsar, vide which bail/surety bonds have been cancelled and non-bailable warrants have been issued.

Learned counsel for the petitioner submits that the petitioner was on interim bail and challan was presented in his absence without giving him notice. It is further submitted that the petitioner is ready to surrender before the trial Court and apply for regular bail. On asking of the Court, Mr. Navneet Singh, DAG, Punjab accepts notice on behalf of the respondent-State. After hearing learned counsel for the parties and considering the aforesaid facts and circumstances of the case, present petition is allowed and the petitioner is directed to surrender before the trial Court on or before 23.01.2023 and he will be released on bail subject to his furnishing fresh bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned. Till then, arrest of the petitioner shall remain stayed. Disposed of, accordingly.
