H. S. Madaan, J. (Oral) This petition for regular bail has been filed by petitioner - Amandeep Singh, an accused in FIR No. 94 dated 1.9.2019, for offences under Section 22-B of NDPS Act, 1985, registered at Police Station Odhan, District Sirsa.

Briefly stated, the prosecution story is that on 1.9.2019, the petitioner -accused was intercepted by the police party while riding a motorcycle in the area of T-point Kalanwali Raod, Odhan and was found in possession of 56 strips of Tramadol Hydrochloride - 100 mg. Batch No. CLE-1901 MFD. 2019 Ex. Date 2021, each strip containing 10/10 tablets total 560 tablets and 9 strips of Alprazolam tablets 1P 0.5 mg. Batch No. ALT-1805 MFD.2019 Ex. CRM-M-49367 of 2019 -2were recovered, without any license and permit. He was arrested in this case.

On completion of investigation and other formalities, he has been challaned. He had moved an application for regular bail before the trial Court, under Section 167 (2) Cr,.P.C., which was dismissed. Now, he has approached this court seeking grant of regular bail. The request is opposed by learned State counsel. I have heard, learned counsel for the parties, besides going through the record.

The recovery effected is less then commercial quantity. As per the custody certificate produced by the State counsel, the accused is in custody for 4 months and 11 days. He is not shown to be involved in any other criminal case. The conclusion of trial is likely to take some time.

Accordingly, the petition is accepted. Petitioner - Amandeep Singh is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate, Sirsa. However, it is made clear that in case the petitioner is found indulging in any criminal act after being granted bail by this Court, this order shall be liable to be withdrawn. ( H.S.
