1. Contempt petition has been filed alleging violation of the order dated 14.09.2017 passed in Civil Appeal No.116 of 2015, whereby in terms of the compromise which has been made the rule of the Court, decree has been accordingly drafted.

2. Non-compliance of decree would not invite contempt proceedings as the same does not come within the ambit of Section 12 of the Contempt of Courts Act, 1971, and does not form contempt in terms of Section 2(2) of the said Act.

3. Contempt petition is misconceived and is dismissed accordingly.

4. However, the petitioner is left open to avail remedies available under the Civil Procedure Code, 1908.
