**** ANOOP CHITKARA, J. (ORAL) Counsel for respondent No. 1 prays that instead of cancelling the bail, this Court may impose other stringent conditions to which respondent No. 1 undertakes to comply with.
In the entirety of facts and circumstance, this Court is not inclined to cancel the bail. However, this Court is inclined to impose further condition which is as mentioned below:
In case, respondent No. 1 repeats the offence or indulges in any kind of criminal activities where sentence prescribed is 7 years or more and it shall be open for any investigating agency to bring it to the notice of the Court seized of the subsequent application that the accused was earlier cautioned not to indulge in criminal activities. Therefore before granting the bail, the concerned Court shall consider the fact that this Court had given him a warning to reform him but he failed to do so. It is clarified that in case the conditions mentioned in the bail order and the aforesaid condition are not complied with, then on this ground alone, the bail shall be cancelled.
Present petition stands disposed of.
