*** Amol Rattan Singh, J. (Oral) By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail'. Learned counsel for the petitioner has produced in Court today two orders passed by this Court (this very Bench) in CRM-M47526 of 2019 and 47581 of 2018 on 28.11.2019, admitting the coaccused of the petitioner, Ravi Kant and Rahul Kumar, to anticipatory bail.

He submits that the petitioner having already been in custody for more than two months, on the same set of allegations, with the report under Section 173 of the Cr.P.C. having been submitted, he too deserves to be admitted to bail.

Crl. Misc. No.M-49583 of 2019(O&M) Having considered the above and that this is the only case stated to be registered against the petitioner (as per the State counsel, on instructions from ASI Deepa Ram), without making any comment on the actual merits of the case, for or against the petitioner, the petition is allowed. The petitioner is ordered to be admitted to bail to the satisfaction of the trial Court.

Petition stands allowed.
