Learned State counsel on instructions from ASI Gurmeet Singh States that upon the representation, proceedings under Sections 107 and 151 BNSS have been taken out, in view of which, learned counsel for the petitioner does not press the petition.

Ordered accordingly. However, in case, any representation submitted by the petitioner is pending or filed with regard to protection of his life and liberty, the same be considered and if any threat perception is found or evidence surfaces substantiating his claim as regards to commission of a cognizable offence, appropriate action be taken in accordance with law. 3.

It is however, made clear that this order shall not preclude the authorities to proceed against the petitioner, in case, he is found involved in any other criminal proceedings, instituted/pending against him, if there is some evidence that surfaces regarding his involvement in a cognizable offence, for which he may be required by the investigating agency.
