(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioners in case FIR No.194 dated 03.11.2019 under Sections 306, 201, 34 IPC registered at Police Station Sadar Sangrur, District Sangrur. At this stage, Mr. Amit Jain, Advocate for Mr. J.S. Binder, Advocate has put in appearance on behalf of the complainant and filed his memo. of appearance in Court, which is taken on record. He submits that after filing of this petition, offence under Section 302 IPC has also been added in the case.

Criminal Misc. No. M-49828 of 2019 -2Faced with this situation, counsel for the petitioners seeks withdrawal of the present petition, however, with liberty to file a fresh one after incorporating Section 302 IPC.
