(ORAL) This is a petition filed under Articles 226/227 of the Constitution of India seeking issuance of a writ of mandamus directing respondent No.2 to decide statutory appeal dated 07.09.2022 (Annexure P-5) preferred by the petitioner under Section 117 of the Border Security Force Act, 1968, against the findings and sentence passed by the Summary Security Force Court along with its confirmation and promulgation; along with certain other prayers.

At the outset, learned counsel for the petitioner submits that, at this stage, the petitioner would be satisfied if the respondents take a conscious decision on the appeal dated 07.09.2022 (Annexure P-5) preferred by the petitioner and pass a speaking order thereon, within a time bound frame.
