This is an application under Section 151 of the Code of Civil Procedure, 1908 for preponing the date of hearing in the main case (CR-59972024) from 20.03.2026 to an early date. 2.

Learned counsel appearing on behalf of the nonapplicant/petitioners' states that he has no objection if the present application is allowed and the date of hearing in the main petition is preponed. 3.

For the reasons stated in the application, the same is allowed. With the consent of learned counsel for the parties, the main revision petition is taken on Board today itself.

CR-5997-2024 -2of Order XII Rule 6 of the Code of Civil Procedure, 1908 but was a case under Order XXIII Rule 3 CPC wherein the parties had entered into a compromise after the filing of the suit. It has further been stated that now a fresh compromise has been entered into between the parties which has been appended alongwith the application (CM-24691-CII-2025) as Annexure A-1 reiterating the terms of the earlier compromise. Learned counsel for the parties have jointly prayed that order dated 09.04.2024 passed by the Trial Court be set aside and the matter be remanded to the Trial Court for disposing of the suit in terms of the compromise.

In view of the above, the present revision petition is disposed off. The order dated 09.04.2024 is set aside and the matter is remanded to the Trial Court with a request to decide the appropriate application, if any, expeditiously and in accordance with law.

The parties are directed to appear before the Trial Court on 09.02.2026, the date already fixed in the suit. 8.
