Aggrieved by slow speed of the trial in the FIR capƟoned above, the accused has come up before this Court under SecƟon 528 BNSS. 2.

NoƟce served upon the official respondent through State counsel. The nature of order which this Court proposes to pass, there is no necessity of calling any response from the State.

Grievance of the accused is that finding the case to be weak, the complainant is unnecessarily delaying the trial by seeking adjournment on lame excuses. 4.

Given the prayer of the peƟƟoner, State is directed not to seek unnecessary adjournment before the trial Court and ensure service of witnesses and their presence before the trial Court on the date fixed. If the complainant will seek exempƟon, Ɵme and again, it is for the State to ensure his presence and trial Court is at liberty to close prosecuƟon evidence in accordance with law.
