***** HARI PAL VERMA, J. (Oral) Prayer in this petition filed under Section 438 CrPC is for grant of anticipatory bail to the petitioner in case FIR No.0163 dated 17.10.2019 under Sections 376, 313, 120-B IPC registered at Police Station Mataur, District SAS Nagar (Mohali).

Learned counsel for the petitioner states that pursuant to order dated 11.02.2020 of this Court, the petitioner has joined investigation on 13.02.2020.

Criminal Misc. No. M-49627 of 2019 -2Learned State counsel, on instructions from SI Meena Hooda, does not dispute the aforesaid fact and submits that the custody of the petitioner is no more required.

I have heard learned counsel for the parties. Considering the fact that the petitioner has joined investigation and his custody is no more required, the present petition is allowed and the interim order dated 20.12.2019 is made absolute. However, the petitioner shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C. At this stage, counsel for the complainant submits that the petitioner after being granted the relief of ad-interim bail, is still calling the prosecutrix.
