)*+ The instant petition has been filed under Section 482 Cr.P.C. seeking quashing of the order dated 01.08.2025 passed by the learned JMIC, Abohar whereby the application for summoning of the witnesses as detailed in the application dated 01.08.2025 has been dismissed. 2.

Learned counsel for the petitioner contends that the application of the petitioner for recalling of the witnesses have wrongly been dismissed by the Court below citing the reason that the same is the third application and has been moved at very later stage. He further submits that as the case under Section 138 of the N.I. Act is a summon trial and the documents or the witness which the petitioner wants to produce is a sale-deed registered at the office of Sub-Registrar, Wazirabad, Gurugram is a relevant piece of evidence to decide the matter in issue and prayed for acceptance of petition. Documents/evidence which petitioner wants to place on record by calling witnesses is sale-deed i.e. document prepared by a public servant while performing his official duty, same is admissible as per Chapter V of the Evidence Act. So, he can tender the certified copy in his defence evidence. Thus, the present petition is disposed of with direction that if the petitioner wants to adduce evidence regarding sale-deed registered at office of Sub-Registrar, Wazirabad, Gurugram, he is at liberty to obtain the certified copy from the concerned authority and tender in his evidence. 5.

Disposed off accordingly.
