ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the respondents to re-fix the pay of petitioners by granting them the benefit of Dearness Allowance along with minimum of pay scales attached to their posts so as to bring their pay at par with minimum pay being availed by similarly situated regular employees.

At the very outset, learned counsel for the petitioners submits that petitioners be rather granted liberty to move an appropriate representation qua their grievance, before the competent authority which may be decided as per law.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the representation, in case the same is filed by the petitioners, by passing a speaking order.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the competent authority/ respondents to look into the representation of the petitioners, in case the same is submitted and pass an administrative order, in accordance with law.
