The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the impugned order dated 23.08.2023 whereby the application under Order 18 Rule 17 of the Code of Civil Procedure, 1908 for cross-examining the witness has been dismissed. The said application was filed in an application under Order 21 Rule 32 of CPC for initiation of contempt proceedings. In the interregnum, vide order dated 06.11.2023, the application under Order 21 Rule 32 CPC itself stands dismissed.

Learned counsel for the petitioner states that an appeal has already been preferred and, hence, he seeks permission to withdraw the present petition with liberty to avail his remedies as available in law. Permitted to do so.
