(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.87 dated 30.04.2019 under Sections 304(B), 34 IPC at Police Station Uchana to the petitioner, who is in custody since 24.05.2019. Counsel for the petitioner herein would contend that the allegations as set out in the FIR do not constitute a demand for dowry, while further contending that other co-accused have been allowed anticipatory bail. Learned counsel for the respondent-State would contend that the death took place in the matrimonial home within a period of two years of marriage. It is further contended that there are allegations in the FIR regarding demand of dowry, while further contending that FSL report has been received, which would reflect that there was presence of aluminium phosphide in the deceased. It is also contended that there were allegations that the deceased was eight months pregnant and her histopathology report is still awaited.
