The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of inquiry report dated 25.05.2018 and consequent decision dated 26.05.2018 whereby petitioner has been dismissed from service. 2.

Learned Senior Counsel for the petitioner points out submissions made in para No.15 of the writ petition. The said para is reproduced as below:- "That in the alternative, it is also humbly submitted by the petitioner that instead of ordering reinstatement of the petitioner after quashing impugned orders or holding fresh enquiry by the PUCASH by giving him an opportunity of leading defence and Competent Authority may be directed to reconsider the case of the petitioner for imposing a lesser penalty including removal from service or accept his DEEPAK BISSYAN 2025.09.26 17:29 I attest to the accuracy and integrity of this document

CWP-34558-2019 (O&M) -2resignation instead of imposition of order of penalty so that it does not stand in his way for future employment." He further submits that there are procedural illegalities warranting interference.

Considering the submissions made in para No.15 of the writ petition, this Court is of the prima facie opinion that competent authority may consider petitioner's request for resignation. 4.

Learned Senior Counsel for the petitioner submits that petitioner would make representation to competent authority. 5.

Faced with this, learned counsel for the respondent submits that petitioner has no case on merits, nevertheless, if he files representation for acceptance of his resignation instead of order of dismissal from service, the competent authority would consider the same in accordance with law.

In the wake of statement of both sides, the instant petition stands disposed of.
