*** GURBIR SINGH , J. (ORAL) The prayer has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case bearing FIR No.260 dated 14.10.2022 under Sections 18(b) of NDPS Act, 1985, registered at Police Station City Malout, District Shri Muktsar Sahib. As per allegation, 1Kg opium was recovered from the petitioner on 14.10.2022 and the petitioner is in custody since then. Learned counsel for the petitioner has submitted that recovery of the opium from the petitioner is of non-commercial quantity. The completion of trial will take long time so, he will be released on bail.

Mr. Jaiteshwar S. Bhandari, AAG, Punjab, has appeared in pursuance of the copy of the petition having been sent to the respondent-State in advance. He has opposed the petition that three other cases registered against the petitioner. In one case, he was acquitted and two other cases are pending trial against him. He is committing crime again and again so, this petition be dismissed.

CRM-M-58447-2022 -2Keeping in view the fact that the petitioner is in custody since 14.10.2022, the completion of trial will also take a long time, no useful purpose would be served by keeping the petitioner behind bars for a long period.

Accordingly, without commenting upon the merits of the case, the present petition is allowed and the petitioner is directed to be released on regular bail, on his furnishing bail bonds/surety bonds, to the satisfaction of learned Trial Court/Duty Magistrate, concerned.
