The jurisdiction of this Court has been invoked under article 226/227 of the Constitution of India with a prayer that this Hon'ble Court may issue a writ in the nature of mandamus directing the respondents to pay interest @ 18% per annum to the petitioner for the delayed period of releasing the retiral dues more particularly the leave encashment of Rs.13,37,220/- which was due to be paid to the petitioner on 31.12.2022.

Mr. Sushil Bhardwaj, learned Additional Advocate General, Haryana, accepts notice on behalf of the respondent-State and assures the Court that the representation dated 30.09.2024 (Annexure P-21) submitted by the petitioner qua interest on the arrears, which are being released with delay, shall be decided by passing a speaking order in accordance with law within a period of eight weeks from the date of receipt of a certified copy of this order. Copy of which shall be furnished to the petitioner within one week thereafter. 4.
