******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.346 dated 05.10.2019 registered for offences punishable under Sections 21 (b) and 27-A of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Bhuna, District Fatehabad. Heard.

As per case of prosecution, 10.35 gms. of Heroin was recovered from co-accused, Vicky @ Hondi, who on interrogation suffered disclosure statement that he had purchased the narcotic from the petitioner. Learned State counsel submits that the petitioner is involved in the trade of narcotics. Earlier three similar cases under the NDPS Act were registered against him in the years 2017, 2018 and 2019. Learned counsel for the petitioner submits that petitioner is a young boy and is being falsely involved on the basis disclosure statement of main accused.

CRM-M-49797 of 2019 -2As and when some contraband is recovered the police has to attempt to reach the supplier and the persons dealing in the trade of narcotics. As per disclosure statement of main accused Vicky @ Hondi, he had purchased the narcotic from the petitioner against whom three other similar cases have already been registered. There is no reason to discard the disclosure statement of the co-accused at this stage and custodial interrogation of the petitioner is required not only to check such type of crimes but also to enquire about the source of supply of narcotics. Keeping in view above facts, I find no reason to exercise the discretionary power of this Court to extend the benefit of anticipatory bail to petitioner.

Dismissed.
