 The petitioner apprehends his arrest in respect of offence of theft of car arising out of an incident vide FIR No. 19 dated 28.01.2023 under Sections 379/411 of the Indian Penal Code, registered at Police Station Division No.5, District Ludhiana, Punjab.

The facts disclose that the petitioner was granted bail by the trial Court on 17.02.2023. However, arrests warrants were issued against the petitioner since he jumped bail and thereafter he was declared as a proclaimed absconder on 28.09.2023.

Learned counsel for the petitioner submits that the said order of declaring the petitioner as proclaimed absconder was set aside by this Court whereafter the petitioner filed an application for grant of anticipatory bail before the Court of Special Judge, Ludhiana which was dismissed on 18.04.2024.

Coaccused in the present case has since been arrested, the investigation is completed against them and thereafter the trial is pending at the stage of adducing prosecution evidence.

The petitioner has been absconding since long and has delayed the trial before the trial Court.

Grant of bail at this stage would amount to grant of premium to default. Accordingly, the bail application is dismissed.
