(ORAL) This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in case FIR No. 100 dated 14.11.2016 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Koom Kalan, District Ludhiana. Counsel for the petitioners states that in the present case the trial is going on, the prosecution evidence is over and the trial is at the defence stage. He further states that inadvertently, on the date fixed, the petitioners could not appear before the trial Court, rather they were sitting in the chamber of their counsel. Non-appearance of the petitioners is not intentional and have never missed any date since the trial commenced. Keeping in view the above facts, but without commenting anything upon the merits of the case, the present petition is allowed. CRM-M-49931-2019 petitioners are directed to surrender before the trial Court within 5 days from today. On their doing so, the trial Court shall release them on bail, subject to their furnishing bail/surety bonds to its satisfaction.
